GST invoice format for a construction labour contractor
A construction labour contractor, the mason, shuttering or bar-bending gang that works for builders on a labour-only basis, bills for measured work or man-days without supplying the main materials. The invoice should show the work type, quantity or man-days, the rate, the building and floor, and a clear 'labour only, material by client' note. Labour-only construction services fall under SAC 9954 codes such as 995456 for masonry and 995454 for concrete work, taxed at 18%, except pure labour for a single independent house, which is exempt.

Extra fields a construction labour contractor invoice needs
Labour-only declaration
Clients and auditors need to know that cement, steel and sand were not supplied by you. A line stating 'labour only; all materials supplied by client' explains why the value is lower and why it is not a works contract.
Work type and measured quantity
Shuttering, bar bending, masonry and plaster gangs are paid per square metre, per tonne or per cubic metre. Listing quantities by type of work matches the builder's measurement sheets.
Man-days or headcount
Some work is paid per man-day. Showing number of workers and days per skill category supports day-work bills.
Building, tower and floor
Builders run several towers at once. Identifying the location for each quantity helps them allocate cost to the right project and phase.
Consumables supplied by you
Labour contractors sometimes supply binding wire, nails or small tools. Listing them separately clarifies whether they change the nature of the contract.
Labour law registration numbers
Builders often ask for the contractor's labour licence and provident fund code. Printing them on the invoice reduces compliance follow-ups.
Standard GST invoice fields
Rule 46 of the CGST Rules applies to every tax invoice, including this one:
✓Supplier name, address and GSTIN
✓Consecutive invoice number (max 16 characters, unique for the year)
GST rules that matter for a construction labour contractor
Labour-only work is still a construction service
Labour-only gangs working on a building supply construction services classified under heading 9954, with sub-codes like 995454 for concrete services, 995456 for masonry and 995472 for plastering. These services are taxed at 18% when supplied to a builder or contractor. Because no materials transfer, the contract is not a works contract, but the rate is the same, and the builder can usually claim credit if it is supplying a works contract onward.
Exemption for single residential units
The services exemption notification exempts pure labour contracts of construction, erection, commissioning or installation of original works pertaining to a single residential unit otherwise than as part of a residential complex. A labour contractor building an individual bungalow for an owner under a labour-only contract can therefore issue a bill of supply. Labour for flats in a builder's project or for commercial buildings does not qualify.
Registration thresholds and builder pressure
Many labour contractors operate below ₹20 lakh turnover. They are not required to register, and an unregistered person cannot charge GST. Builders sometimes ask for a GSTIN because they want input tax credit. If you register voluntarily, you must charge GST on all taxable supplies and file returns monthly or quarterly, so weigh the compliance cost against the business you will win.
Distinguishing labour supply from construction service
If you simply supply workers whom the builder directs and supervises, the service may be labour supply or manpower supply under group 99851, not construction service. If you take responsibility for completing measured work with your own supervision, it is a construction service under 9954. The rate is 18% in both cases, but the correct classification affects reverse charge and the treatment of the builder's labour law obligations.
Income tax TDS and GST
Builders deduct income tax TDS under section 194C from payments to labour contractors. This does not reduce your GST. Show GST on the full value of work done and reconcile Form 26AS separately. Do not net TDS from the taxable value on the invoice.
Common billing mistakes
✕Claiming the single residential unit exemption for labour work on apartments in a builder's project.
✕Charging GST without being registered because the builder asked for it.
✕Billing a lump sum per floor without quantities, so the builder cannot match measurement sheets.
✕Reducing the taxable value by the TDS amount the builder deducts.
✕Supplying cement or steel occasionally but still calling the contract labour-only.
Construction labour contractor GST invoice: FAQ
What SAC code should a labour contractor use?
+
Use the 9954 sub-code for the work type, such as 995454 for concrete and shuttering, 995456 for masonry and 995472 for plastering. Manpower supply without responsibility for work falls under group 99851.
What GST rate applies to labour-only construction?
+
Labour-only construction services are taxed at 18%, except pure labour for a single independent residential unit, which is exempt.
Do I need GST registration as a labour contractor?
+
Registration is required when aggregate turnover exceeds ₹20 lakh, or ₹10 lakh in special category states. Below that, registration is optional.
Can a builder claim credit on my labour bill?
+
A builder supplying works contract services to a client can usually claim it. A builder selling flats at the concessional 1% or 5% rates cannot claim input tax credit.
How should man-day billing appear on the invoice?
+
List skill category, number of workers, days and rate, and the period of work. This supports the value and avoids disputes.
Can a labour contractor opt for composition?
+
Yes, a labour contractor whose aggregate turnover was up to ₹50 lakh in the previous year can opt for the composition scheme for service providers at 6%. You then issue a bill of supply, cannot charge GST to the builder and cannot claim credit on tools or consumables.
