Excavation work versus machine hire
When you are responsible for completing excavation or levelling to the client's levels and are paid per cubic metre, you are supplying a construction service under SAC 995433, excavating and earthmoving services, taxed at 18%. When the client directs the machine and pays per hour, you are leasing construction machinery with operator under SAC 997313. Both are taxable, but the classification determines the rate logic and how the client reports the expense.
Rate on machinery hire follows the machine
The services rate notification treats leasing or renting of goods with or without operator, where not specified elsewhere, at the same rate as the supply of those goods. Self-propelled bulldozers, graders, excavators, loaders and road rollers under HSN 8429, and other earthmoving and boring machinery under 8430, are in Schedule II of Notification 9/2025 at 18%. Hire of these machines is therefore at 18%. If you rent out a tractor, which is in the 5% schedule, the rate changes accordingly.
Earthwork for Government at 18%
Composite works contracts involving predominantly earthwork, more than 75% of the contract value, provided to Government, and the corresponding sub-contracts, were at 12% until 21 September 2025. The 56th GST Council recommended and Notification 15/2025 implemented a move to 18% with input tax credit. Earthmoving contractors working on Government and local body jobs must update quotations and invoice templates for supplies after that date.
Diesel and the value of supply
If you buy diesel and include it in the hire rate, its cost is part of your taxable value. Diesel is outside GST, so you pay VAT on it without credit, which raises your cost. If the client supplies diesel free of charge, do not add it to your bill. Mention fuel terms on the invoice so the client's auditor understands the rate.
GST TDS and income-tax TDS
Government clients deduct 2% GST TDS on contracts above ₹2.5 lakh. Private clients may deduct income-tax TDS under section 194C or 194I for machinery hire depending on the contract. GST on your invoice is calculated on the full value; deductions appear only in the payment advice. Reconcile GSTR-7A certificates with your invoices every month.
